These Terms of Sale (“Terms”) govern the purchase of products and services (“Products” and “Services”) from HOA Technology (“we,” “our,” “us”). By placing an order, you (“you,” “Customer”) agree to these Terms.
All orders are subject to acceptance by us. We may refuse or cancel any order at our discretion, including due to product availability, errors in pricing or description, or concerns about fraudulent activity.
An order is considered accepted once we issue written confirmation (such as an invoice, receipt, or email confirmation).
Prices are listed in U.S. dollars unless otherwise stated. Taxes, shipping, and handling may apply and will be added to your invoice.
Payment is due at the time of order unless otherwise agreed in writing.
Credit Card Payments: If you choose to pay by credit card, a processing fee of 2–5% may apply.
Failure to pay when due may result in suspension of services, withholding of products, or cancellation of the order.
Hosting Services are billed on a quarterly or annual subscription basis, in advance.
Other services, such as installation or consulting, may be billed according to the terms stated in your service agreement or invoice.
For physical products, shipping timelines will be provided at checkout or in your order confirmation. Delays may occur due to supply chain issues or carrier delays.
For services (including installation, support, and hosting), delivery timelines will be agreed upon in your service agreement.
Products: Returns are only accepted for defective or damaged products within 30 days of delivery, unless otherwise required by law. Returned products must be unused, in original packaging, and accompanied by proof of purchase.
Services: Prepaid service fees (including installation, support, or hosting) are non-refundable, except where required by law or where we terminate without cause (in which case, a prorated refund may apply).
Hosting Plans: Unless terminated under Section 13 of the Terms of Service, hosting fees are non-refundable once the billing cycle begins.
Products: Products may include manufacturer warranties. We do not independently warrant products beyond what the manufacturer provides.
Services: All services are provided “as is” and without warranties of uninterrupted or error-free performance.
To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages, including lost profits, data loss, or business interruption, arising from the purchase or use of our Products or Services.
These Terms of Sale are governed by the laws of the State of California, excluding conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in California.
